DescriptionRussell says the death of Lord Moncrieff causes the appointment [of Scotch Judge] to fall to the Crown. Ought the vacancy to be filled? Who ought to fill it? The Salaries Committee think a reduction ought to be made in the number of Scotch Judges, but Scotch opinion (Bench, Bar and Country) is against it. Russell does not recommend it. Who shall be appointed? Lord Mackenzie reported to be dying. Mr Macneill, Sir Robert Peel's Lord Advocate, would be Mackenzie's best successor. Therefore, Russell recommends this and the present Lord Advocate.
